Medical negligence and medico-legal issues have always been Engelin’s interest. She has represented medical practitioners as well as patients in claims relating to medical negligence.

 

Engelin has also represented medical practitioners in disciplinary proceedings before the Singapore Medical Council (“SMC”).

One of her reported cases at the Court of Appeal involved the application on behalf of a practitioner for a certiorari to quash the decision of the Complaints Committee to hold a formal inquiry before the Disciplinary Committee of the SMC. She has also represented an advocate and solicitor in challenging the findings of an inquiry committee of the Law Society.

Perseverance and passion

Perseverance and passion would best characterise the qualities needed to win medical negligence disputes. Vijay Kumar, a senior consultant at Engelin Teh Practice, displayed these virtues to the fullest in this protracted matter. Litigation started back in January 2015 but was preceded by a 3-year struggle by our client to gather evidence, appreciate the facts, and research her case and also to try to engage with the hospital. When the client first contacted our firm’s lawyer, Vijay in 2012, he recognised immediately the significance of the case (a potentially life-threatening lung cancer) and the need to help this lady to obtain justice.

 

Medical negligence disputes tend to take a long time before they are settled. This is due mainly to their complexity. Facts are not easily verified as most medical issues involve technical knowledge. Expert witnesses for the plaintiff are often at odds with expert witnesses for the defendant and vice versa.
